STOCKTON BRAIN INJURY LAWYERS

Brain injuries (sometimes called Traumatic Brain Injuries or “TBIs”) can have a devastating effect on a person’s life. As modern medicine and science progress, concussions and other brain injuries are becoming better understood, and the picture that is being painted is alarming. Victims of a brain injury often require costly medical care, sometimes for the rest of their lives. This is one of the reasons why it’s important for the victim’s family to fully explore their legal options. When a brain injury is caused by negligence, a personal injury lawsuit may be the only way for the victim to recover the compensation necessary to support this future care.

Schwinghamer Law has a record of success when it comes to representing brain injury victims in personal injury cases. While every case is unique, a successful brain injury lawsuit can allow victims and their families to recover damages for past and future medical expenses, lost income, neuropsychological testing, neuro-retraining, money for pain and suffering, and more.

If you or a loved one has suffered a brain injury caused by another’s negligence, our Stockton brain injury lawyers are here to help. Call us at (209) 425-2520 to schedule your free consultation with an experienced personal injury attorney

WHAT IS A TRAUMATIC BRAIN INJURY

The brain is composed of soft tissue, suspended within the hard bony confines of the skull. When the human body is exposed to trauma, the brain literally bumps up against the hard skull and can become damaged and bruised. This type of injury can happen when a person falls, gets in a car or motorcycle accident, or sustains a blow to the head. Even in cases where there is no direct impact to the head, like a rear-end auto accident, the acceleration and deceleration forces of the crash can cause the brain to strike the inside of the skull and cause injury.

The most well known form of brain injury is a concussion. A concussion is any injury to the brain that results in temporary loss of normal brain function. Concussions have gained national attention in recent years due to their relationship with contact sports. According to the University of Pittsburgh’s Brain Trauma Research Center, more than 300,000 sports-related concussions occur annually in the U.S.

WHAT TYPES OF COMPENSATION ARE AVAILABLE IN BRAIN INJURY CASES

Under California Law, brain injury victims can receive compensation for the following:

  • Property Damage
  • Reimbursement of past medical expenses
  • Payment for future medical care, or a future life-care plan
  • Money damages for loss of IQ points
  • Lost wages
  • Diminished earning capacity
  • Vocational retraining
  • Pain and suffering
  • Embarrassment and inconvenience
  • Loss of quality of life

California law also allows spouses of personal injury victims to make what is called a “loss of consortium” claim. Brain injuries can be so destructive to a person’s life that their spouse can suffer his or her own damages, or in some cases become a caregiver. California law recognizes this as an item of legal damages and allows additional compensation for the spouse for these unique injuries.

At Schwinghamer Law, we have experience helping residents of Stockton, Sacramento, and the surrounding communities recover for their brain injury claims through the use of personal injury lawsuits.

DIAGNOSING BRAIN INJURIES

If you or a loved one sustained a personal injury, and doctors suspected a possible traumatic brain injury, the first step in diagnosis is usually medical imaging. For example, doctors may perform a CT Scan or an MRI scan of the brain. These medical imaging scans can be helpful in discovering serious conditions such as hematoma or a brain bleed. However, even if nothing shows up on the scan, there may still be a brain injury. In fact, “Mild Traumatic Brain Injuries” or “MTBI” are defined as brain injuries that do not show up on normal imaging scans. If you suspect a brain injury, discuss it with your doctor. Although it is called a “mild” traumatic brain injury, there is really nothing “mild” about it. Even “mild” traumatic brain injuries can affect a person for life.

The following are concussion symptoms which may indicate a brain injury:

  • Headache
  • Blurry vision
  • Dizziness
  • Nausea or vomiting
  • Poor balance
  • Confusion
  • Memory loss
  • Ringing ears or tinnitus
  • Difficulty thinking or concentrating
  • Sensitivity to light
  • Loss of smell or taste
  • Muscle weakness
  • Difficulty Communicating
  • Non-reactive pupils

If any of these occur after a blow to the head or a traumatic accident, a health-care professional should be consulted as soon as possible. If you believe your brain injury was caused due to another person’s negligence, we encourage you to contact an experienced attorney at Schwinghamer Law.

HOW ARE BRAIN INJURY CASES DIFFERENT FROM OTHER PERSONAL INJURY CASES

While every case is different, brain injury cases can be more complicated and more difficult than other personal injury cases. When a person sustains a brain injury, it can affect every part of their life from their ability to work, to their personal relationships, to their own emotional well-being. In addition, brain injuries can actually cause measurable loss of IQ points, and can make it more difficult to think and remember things. Finally, brain injury cases can be difficult because they can be an “invisible injury.” While a broken arm will show up on an X-Ray, brain injuries often must be proven by other means, such as neuropsychological testing. Having an experienced lawyer who understands brain injuries can make all the difference in gathering evidence and protecting your rights.
